PERSONNEL POLICIES

Staff members should have a written policy statement regarding their employment. The personnel manual is an important document to the employee, to the person who must evaluate the employee's performance and to the board. Written personnel policies include employment practices; compensation policies; policies relating to paid time off; benefits; and general personnel practices within the organization. Arts organizations shall have a non-discriminatory, Equal Employment Opportunity and Affirmative Action statement for hiring and firing all employees. Arts organizations should have written job descriptions for all staff. Job descriptions should include the hiring and firing policies of the organizations.

Sample Contract

PROFESSIONAL SERVICES AGREEMENT

This agreement ("Agreement") is made and entered into on the ___ day of __________, (year), by ___________ ("Contractor") and ____________________ ("Organization") for independent contractor services to the Organization, a New York not-for-profit corporation with its principal offices located at (address).

Contractor will provide the services set forth in this agreement for a contract period of six months, (date) through (date) (the Contract Period). Contractor shall work with and report to the Executive Director to provide the following services:

As payment for services rendered hereunder, Contractor will be paid a total of $XXX, to be paid in ___ payments at $XXX per payment. The contract period begins on (date) and ends on (date).

Contractor will submit written statements of services rendered by the end of the month and will be paid on the ___ of the month. The Organization will cover the cost any travel required for the project. The Organization will cover the cost of long distance phone calls. Reimbursement for printing and other office services shall be approved in advance by the Executive Director. Expenses will be submitted on a monthly basis.

In performing the services hereunder, the Contractor shall be an independent contractor and not an employee of the Organization. As such, Contractor shall not be entitled to health insurance coverage, sick leave, vacation, pension, or other benefits associated with regular employment at Organization and no income taxes will be withheld from payment to the Contractor for services rendered hereunder.

This agreement may be terminated by Organization or the Contractor at any time, with or without cause, by furnishing fifteen (15) days notice to the other party in writing. In the event of termination, payment will be made in full for services rendered through the final day of work.

This agreement shall constitute the entire agreement between Contractor and Organization. If the scope of work greatly exceeds what is detailed in this agreement, and the agreement may be altered only by subsequent mutual agreement in writing.
